DMCA & Copyright Infringement Policy — MECTips (https://mectips.com)

1. Overview

MECTips respects the intellectual property rights of copyright owners and expects users of this site to do the same. This page describes how to submit a Digital Millennium Copyright Act (DMCA) takedown notice, how we handle those notices, how to submit a counter-notice if you believe material was removed by mistake, and our repeat-infringer policy. This policy is intended to comply with the requirements of 17 U.S.C. § 512 (the DMCA) and with commonly used content removal procedures by major services. (U.S. Copyright Office)


2. Designated Copyright Agent (how to submit a takedown)

To file a DMCA takedown notice with MECTips, send a written notice to our designated copyright agent using one of these methods:

All notices must meet the DMCA statutory requirements listed in Section 3 below. We will not accept notices by telephone. For faster handling, email is preferred. (U.S. Copyright Office)


3. What a valid DMCA takedown notice must include

To be effective and legally sufficient, your takedown notice must include each of the following elements (these are the elements specified in 17 U.S.C. § 512(c)(3)): (U.S. Copyright Office)

  1. Physical or electronic signature of the copyright owner or a person authorized to act on behalf of the owner (a typed full name is acceptable for electronic notices when sent from the owner/agent’s email).
  2. Identification of the copyrighted work(s) claimed to be infringed (title, registration number if available, or a clear description).
  3. Identification of the material claimed to be infringing, and information reasonably sufficient to permit MECTips to locate the material on our site (for example the full URL(s) where the material appears).
  4. Your contact information — name, mailing address, telephone number, and an email address at which you can be contacted.
  5. A good-faith statement that you have a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
  6. A statement, under penalty of perjury, that the information in the notice is accurate and that you are the copyright owner or authorized to act on the owner’s behalf.
  7. A statement that you consent to jurisdiction of the federal district court for the judicial district in which your address is located (or if outside the U.S., that you will accept service from the person who provided the alleged infringement notice), for the purposes of any counter-notification. 4. Takedown notice — suggested template (fill in and send)

Below is a ready template you can use. Copy, complete, sign, and submit to dmca@mectips.com (or mail to the postal address above).

Jurisdiction consent: I consent to the jurisdiction of the Federal District Court for the judicial district in which my address is located (or, if outside the U.S., I consent to the jurisdiction of the Federal District Court where MECTips is located), and I will accept service of process from the person who provided notification of the alleged infringement.

5. How MECTips processes copyright notices

  1. We will acknowledge receipt of a DMCA notice by email to the complainant’s address when we have sufficient contact information.
  2. If the notice meets the statutory requirements, we will act expeditiously to remove or disable access to the allegedly infringing content and will notify the user who posted the content that the content has been removed or disabled.
  3. We will provide the user (uploader) a copy of the takedown notice and information about how to send a counter-notice (see Section 6).
  4. If the user timely submits a legally sufficient counter-notice, we will follow the procedures required by 17 U.S.C. § 512 — typically we will restore access to the removed material no less than 10 and no more than 14 business days after receipt of a counter-notice unless the original complainant files an action seeking a court order to restrain the user from engaging in infringing activity. 6. Counter-notice (if your content was removed and you believe that was a mistake)

If your content was removed after a DMCA takedown and you believe the removal was a mistake or misidentification, you may submit a counter-notice to dmca@mectips.com. A counter-notice must include the elements set forth in 17 U.S.C. § 512(g)(3), including: (Legal Information Institute)

  • Your physical or electronic signature.
  • Identification of the material that was removed and the location at which the material appeared before it was removed (full URL(s) preferred).
  • A statement under penalty of perjury that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification.
  • Your name, address, telephone number, and email, and a statement that you consent to the jurisdiction of the federal district court in which your address is located (or, if outside the U.S., to an appropriate judicial body), and that you will accept service of process from the person who provided the original infringement notice.
  • A statement that you will accept service of process from the complaining party (or their agent).

Counter-notice sample (short):

After receiving a valid counter-notice we will notify the complaining party and, unless the complainant files a lawsuit seeking a court order, we may replace the removed material within 10–14 business days. (U.S. Copyright Office)


7. Repeat infringer policy

To retain eligibility for DMCA safe-harbor protection, MECTips maintains and implements a repeat-infringer policy. Users who are determined to be repeat infringers — for example, those with multiple valid takedown notices or other clear evidence of repeated infringement — may have their accounts suspended or terminated in appropriate circumstances. MECTips will determine appropriate action on a case-by-case basis and will document actions taken to enforce this policy. (U.S. Copyright Office)


8. Requests to modify or remove non-copyright content (privacy, defamation, personal data, etc.)

If you seek to remove or modify content for reasons other than copyright (for example: privacy, defamation, sensitive personal data, or other legal issues), please contact our content team at privacy@mectips.com and provide:

  • The exact URL(s) of the content in question.
  • A clear explanation of the legal basis for the request (privacy, defamation, etc.).
  • Government ID or other proof of identity (if required to verify the request).
  • Any relevant supporting documentation or court order.

MECTips evaluates these requests in good faith and may remove or modify content as appropriate under our policies and applicable law. For content that also involves copyright, please use the DMCA procedure above. 9. No admission of liability / site responsibility

MECTips is a platform for publishing informational content and user contributions. We are not responsible for determining whether user content infringes a third party’s rights prior to posting. However, upon receipt of a valid DMCA notice we will act promptly to remove or disable access to allegedly infringing material as required by law. We reserve the right to challenge or refuse deficient notices and to restore content following a valid counter-notice consistent with the DMCA. (U.S. Copyright Office)


10. False statements and penalties

Knowingly submitting a false DMCA notice or counter-notice may expose the sender to liability for damages (including costs and attorneys’ fees). We encourage parties to consider fair use and seek legal advice before submitting notices. Case law has discussed fair-use considerations in the notice process; copyright owners should consider whether an asserted use is lawful prior to sending notices.


11. Changes to this policy

MECTips may update this DMCA & Copyright Policy from time to time. The version posted on this page is the controlling version and the effective date is listed at the top.
